Sector 86 building on green belt in Noida, sealed

Future of hundreds of homebuyers in Sector 86 hangs in the balance after Noida Authority and UP police sealed an under-construction 14-storey building on September 20. Officials said that the land the housing project was being constructed on falls under the greenbelt according to Noida’s Master Plan.

V K Panwar, additional CEO of Noida Authority, said that the authority had thoroughly examined the disputed area, physically as well as on maps. “As per Noida’s master plan, the project is being developed on land which is earmarked for a green belt, a sector connecting road and for industrial purpose. We have asked the developer to stop construction work as it is illegal,” he said.

Panwar said that the authority will issue a notice to the developer and will also file a case in the Allahabad High court to get a stay on construction. “One cannot change land use for personal purpose. As the land is earmarked as a greenbelt, the developer has no right to develop the site beyond land use,” he said.

The developer, Horizon Concept, argues that they had sought clearances for construction from the zila panchayat, with office bearers of the panchayat supporting the claim, saying that the state government had empowered them to pass layout plans.

“Horizon Concept group had started construction on Iridia project after approvals from zila panchayat. Some officers of Noida Authority have initiated action against us because of their vested interests. We have a court order in our favour as well,” said Suninder Sandha, promoter of the group.

Panwar though refuted the claims of the developer. “The stay order given by the civil court cites the land in his possession, but the order does not say that he can construct on the land beyond what the master plan and land use allow,” he said.
